Appeals Policy

Purpose

This Appeals Policy establishes a fair and transparent process for students who wish to challenge decisions related to assessment outcomes, special accommodations, and investigations into suspected malpractice or maladministration. Our goal is to address concerns promptly and ensure the integrity of our training programs.

Scope of Appeals

  • Assessment Results: Challenges to grades, certifications, or other outcomes of assessments.
  • Reasonable Adjustments/Special Considerations: Disputes regarding requests for accommodations or modifications to assessments.
  • Malpractice/Maladministration Investigations: Appeals against findings or consequences resulting from investigations into suspected violations of exam policies or academic misconduct.

Appeals Procedure

  1. Informal Resolution: Students are encouraged to first address concerns directly with the relevant instructor, assessor, or staff member. Attempts to reach an informal resolution should be made as soon as possible.
  2. Formal Appeal Submission:
    • If the issue cannot be resolved informally, the student may submit a formal appeal in writing to the Appeals Officer at mail@myskills.ca.
    • The appeal must include:
      • Student’s name and contact information
      • Clear description of the decision being challenged
      • Specific grounds for the appeal (e.g., procedural irregularity, new information, perceived unfairness)
      • Supporting documentation, if applicable
      • Desired outcome
  3. Appeal Review:
    • The Appeals Officer will acknowledge receipt of the appeal in a timely manner.
    • The review process will be impartial and may involve:
      • Gathering additional information from involved parties
      • Consulting relevant policies and procedures
      • Reviewing assessments or relevant materials
    • The student may be invited for a discussion, with or without representation.
  4. Decision and Notification:
    • The Appeals Officer will render a written decision within 7 days.
    • The decision will provide reasoning and inform the student of their options if the appeal is unsuccessful.

Timelines

Appeals must be filed within 7 days of the disputed decision or outcome. Extensions may be granted in exceptional circumstances.

Limitations

  • Academic judgment is generally not subject to appeal unless procedural errors or bias can be demonstrated.
  • This policy does not replace any legal remedies available to the student.

Additional Provisions

  • Representation: Students may seek advice or be accompanied by a representative during the appeals process.
  • Records: Myskill’s Training Solutions will maintain a record of appeals and their outcomes.
  • Policy Review: This policy will be periodically reviewed and may be updated as needed.
